1. Agreement to Terms

By accessing or using Arktis ("Service"), provided by Arktis Inc. ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

Arktis provides web analytics services including:

  • User journey tracking and analytics
  • Session recording capabilities
  • Conversion tracking and attribution
  • Traffic source analysis
  • AI-powered insights

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to use the Service to:

  • Track users without appropriate consent where required by law
  • Collect sensitive personal data (health, financial, etc.) without explicit consent
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware or harmful code
  • Interfere with the Service's operation
  • Attempt to gain unauthorized access to our systems
  • Resell or redistribute the Service without authorization

5. Your Responsibilities

Privacy Compliance

As a user of our analytics Service, you are responsible for:

  • Implementing appropriate consent mechanisms on your website
  • Maintaining a privacy policy that discloses your use of analytics
  • Complying with GDPR, CCPA, and other applicable privacy laws
  • Obtaining necessary consents before enabling session recordings

Data Accuracy

You are responsible for the accuracy of data you provide and any configuration of the Service.

6. Data Processing

When you use Arktis to process visitor data, we act as a data processor on your behalf. Our data processing practices are detailed in our Privacy Policy.

For EU customers, we can provide a Data Processing Agreement (DPA) upon request.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Arktis Inc. and are protected by international copyright, trademark, and other intellectual property laws.

The tracking script and documentation are provided under license for use with the Service. You may not copy, modify, or distribute the tracking script except as necessary to use the Service.

8. Payment Terms

Paid plans are billed in advance on a monthly or annual basis. You agree to:

  • Pay all applicable fees as described in your plan
  • Provide accurate billing information
  • Update payment information as needed

Refunds are provided at our discretion. If you cancel, you retain access until the end of your billing period.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.

10. Limitation of Liability

To the maximum extent permitted by law, Arktis Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses.

Our total liability for any claims under these Terms shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Indemnification

You agree to indemnify and hold harmless Arktis Inc. and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date.

Continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.
